Bluescape Vacation Rentals Terms & Conditions

Thank you for choosing a Bluescape Vacation Rentals property in the fabulous Florida Keys! We hope you enjoy your stay!

Please carefully review our Terms & Conditions prior to signing your rental agreement.

Guest Responsibilities

Guests are expected to take care of the Rental, its appliances and furnishings and maintain the Rental in a neat and sanitary condition. Guest will leave the Rental in the same condition at check in, including furniture placement. Guest is responsible for the negligent acts of their Guests. Guest shall not use the Dwelling for any disorderly or unlawful purposes or in any manner that is offensive to others. Dwellings will not be used in any way that would constitute a breach in local or federal laws. Guest will maintain that noise levels on the property and inside the dwelling do not impede the quiet enjoyment of others in the neighborhood. A violation of any law or covenant that results in a disturbance will be just cause for immediate eviction and forfeiture of all rent paid and forfeiture of the entire security deposit. Guest shall not use the Rental for any commercial activity, prom groups, school or graduation groups, or events in general. We rent only to family groups and responsible adults 25 and older. Adults can not rent on the behalf of underage guests or other guests. The Rental shall be used for residential purposes only. Guests will be required to produce valid photo identification – State DL or State ID or valid Passport is the only forms of identification accepted. Noncompliance will result in forfeiture of all monies paid and Rental Manager’s right of refusal to allow access to the Rental. Guest shall not sublet Rental or allow anyone to share Rental without Rental Manager's prior written consent.

Arrival & Departure

Check-in time is no earlier than 4:00 PM on arrival date. This time may be delayed should unforeseen circumstances arise. Check-out time is NO LATER than 10:00 AM on the departure date. If available, an early Check In and/or late Check Out option may be available for an additional fee (Not an option during Peak Times). If Early Check and/or Late check out are approved you will get a email confirmation from the reservation team.

Reservations

All Reservations are subject to Bluescape Vacation Rentals and Property Owner approval. Online rates are subject to change without notice. Should there be ANY issues with the reservation, you will be contacted within 48 hours.

Payments and Credit Card Authorization and Auto-charging

Initial deposit payment of 25% due at time of booking, plus either $55 Damage Waiver Policy or a Security Deposit (minimum of $1000 and varies based on location of rental property). Outside of 60 days of arrival, Initial deposit payment is due to reserve property. If Guest reserved with a credit card at time of booking, that credit card will be charged automatically the full remaining balance due. Within 60 Days of Arrival, Total Cost is due to reserve property. We offer Vacation Rental Insurance at 7.65% of the total rental rate.

Security Deposit / Damage Waiver Policy

Bluescape Vacation Rentals HIGHLY recommends Guest to purchase the Damage Waiver Policy for $55. This Damage Waiver policy may cover the insured Guest's unintentional damages to the interior of the Rental or damages to real or personal property of the Rental as a result of inadvertent acts or omissions during your stay provided these damages are disclosed to the Rental Manager in writing prior to check-out. The Insurer will reimburse the cost(s) of repair or replacement of such property up to a maximum benefit of $3000. Certain terms and conditions apply. If you do not wish to purchase the Damage Waiver policy, a minimum of $1000 Security Deposit will be required (this Security Deposit amount will vary based on the individual Rental property's requirements.) If Guest purchases the Damage Waiver Policy, the Security Deposit will not be necessary. If Guest does not purchase the Damage Waiver Policy, the security deposit will be required at time of booking. The security deposit is fully refundable within 15 days of check-out providing there is no damage, excess utilities as noted in the property description, excess cleaning or inventory unaccounted for including, but not limited to keys and/or gate passes. Full details of the Damage Waiver Policy coverage are contained in the Description of Coverage or Insurance Policy here:  https://www.csatravelprotection.com/certpolicy.do?product=G-20VRD.

Damages caused by Guest

A Valid Credit Card to be kept on file is required upon Reservation. Your reservation will either charge $55.00 for a Damage waiver to cover up to $3,000.00 in damage or we will collect a security deposit at time of booking. Should any Guest damages cost above the coverage of the damage waiver or above the amount of security deposit, the Credit Card on file will be charged for any of these costs. Guest hereby grants consent to charge Credit Card on file for any damages, missing items, excessive cleaning, fines, and, if necessary, cost incurred to remove Guest from property.

Utilities & Excessive Charges

Utilities are provided at each rental property. Any excessive uses will be charged to the Guest. Violations of any local water restrictions / ordinances will be charged to the Guest. Please ensure that all faucets and TVs are turned off at the time of departure. Please leave the air conditioner on and ensure the thermostat is set to a temperature between 74-80 degrees with fan speed set to Auto. Keep windows and doors closed while the air conditioner or heater are turned on. Do not leave your windows or doors open as this will cause the air conditioning unit to freeze up and/or malfunction and may result in additional repair charges to Guest.

Occupancy

Approved Guests are persons who will occupy the Premises. No unlawful activity or any other activity that constitutes a nuisance is permitted on the Premises. Approved Guests take full responsibility for all lost or broken items, and any damages to the Property of any kind. The number of Guests as it appears on your reservation confirmation, is the maximum total occupancy. Unauthorized people at the vacation rental at any time is considered a violation of the rental agreement and will cause immediate eviction. No exceptions or refunds are given for changes in the number of Guests after your arrival. Please inform us of any change in the number of Guests before your arrival to avoid any problems with your stay. We will be happy to attempt to accommodate you with an additional Rental, if available and needed.

Housekeeping and Condition of Premises

Our goal is to provide you with the cleanest accommodation possible. Guest shall, on arrival, examine the Premises, all furniture, furnishings, appliances, fixtures, and landscaping, if any, and shall immediately report, in writing, if any are not in operating condition or are in disrepair. Reporting repairs does not give Guest the right to cancel this Agreement or receive a refund of any payments made. Please call the Rental Manager if the home is not cleaned to your satisfaction upon check-in. Our housekeeping team will correct the problem in a timely and professional manner. We cannot be held accountable for problems we are not aware of, please let us know at time of check-in. You are charged a cleaning fee when you make your reservation. Housekeepers do not wash dishes or pick up trash around the vacation rental. Do not place any bait, unwrapped fish or lobster in the refrigerator or freezer unless it is specifically labeled as Bait Storage. Bait and unwrapped fish or lobster must be kept in an outside cooler or labeled bait freezer only. The cleaning fee allows up to two loads of laundry. The Guest will be charged additional cleaning fee(s) for any excessive cleaning or excessive laundry. Please return the vacation rental neat and orderly at check-out.

If you are staying a week or longer and want additional cleanings, we'll be happy to arrange that for an additional fee.

Trash

Garbage pick-up days are Monday and Thursday mornings. Trash must be put inside a plastic garbage can before placing it in trash receptacles. Please place trash cans by the curb for pick up the night before. Recycling pick-up is on Wednesday.

Maintenance & Reporting

Guest shall properly use, operate, and safeguard the Premises including, if applicable, any landscaping, furniture, furnishings, appliances and all mechanical, electrical, gas and plumbing fixtures, and keep them clean and sanitary. Guest shall immediately notify Rental Manager of any problem, malfunction, or damage. Guest shall pay for all repairs or replacements caused by Guest, excluding ordinary wear and tear. Guest shall pay for all damage to the Premises as a result of failure to report a problem, malfunction or damage in a timely manner.

Strict Noise Ordinance

Monroe County has a strict noise ordinance that must be followed. Guest will maintain that noise levels on the property and inside the dwelling do not impede the quiet enjoyment of others in the neighborhood. A violation of any law or covenant that results in a disturbance will be just cause for immediate eviction and forfeiture of all rent paid and forfeiture of the entire security deposit. No loud noises, music, loud vehicles are allowed between the hours of 10:00 pm and 7:00 am. Please note that if these rules are not followed you can be fined and asked to vacate the property. Terms include a No Tolerance Policy regarding excessive noise, parties, or disturbing neighbors. Please make sure you are comfortable with our Terms as they are strictly enforced.

Cancellations & Trip Insurance

Reservations for this property are fully refundable with atleast 60 days written notice prior to check-in, but will incur a $250 cancellation fee. Reservations cancelled 60 days or less from time of Check-in are non-refundable. However, the Rental Manager will attempt to rebook the rental property to another Guest. If Rental Manager is able to rebook the full stay, Guest will be refunded their entire rental rate amount minus a $250 cancellation fee. We do offer trip insurance that costs 7.65% of the gross rental fee and allows you to cancel with certain conditions and restrictions. Please speak with your Rental Manage for more details. This can only be purchased at the time of the reservation.

Returned Checks

Guests will be responsible for a $50 returned check fee in addition to a fee of $100 or 10% of the face value of the check, whichever amount is greater. This is for any check returned for insufficient or uncollected funds.

Keys

In the event that the Rental Manager decides, in its unfettered discretion, that the loss of the keys by the guest represents a significant security risk to the property, a $400 re-keying fee will be assessed and charged to the Guest.

Emergencies / Maintenance / Service Calls

In the event of a problem getting in the vacation rental or if there are problems with the condition or functionality of the vacation rental, please immediately contact your Rental Manager and the Bluescape Vacation Rentals office at 305-395-3799. If it is after office hours, we will make every effort to return your call as soon as possible.

Maintenance - Regular maintenance is performed on all properties, and every effort is made to keep all equipment in working order. However, as with all homes, malfunctions do occur unexpectedly. If something is not working, please notify the office immediately. Please respect that emergencies take precedence. Any problems must be addressed immediately. Bluescape Vacation Rentals cannot be held accountable for problems that we are not aware of, so please notify us as issues occur. Housekeeping or maintenance problems will not be addressed at check-out or after departure. However, under no circumstances will there be any discounts or reduction in rents or refunds for any mechanical failure of air conditioners, dishwashers, refrigerators, washers, dryers, TV, internet service, swimming pools, spas, appliances or amenities. Service calls - Tenants will pay for any unwarranted service calls, such as plumbing, electric, air- conditioning, etc. If the repair technician determines that the call was unwarranted or caused by renter error, the service call and repair will be deducted from the security deposit. Nothing but septic safe toilet paper products in the toilet. Plungers are provided if a clog occurs. Please do not pour grease down the drains.

Right of entry

Guest(s) agree that Bluescape Vacation Rentals reserves the right to enter the rental property at any time to investigate disturbances, check occupancy, check for damage, to make repairs, alterations, or improvements as we may deem appropriate.

Smoking

NO SMOKING IS PERMITTED INSIDE THE DWELLING. Smoking is only allowed outside at some of our rental properties. Oil lamps and incense are not permitted due to the long-lasting odor. If these policies are violated, there is a $1000 fee that will be charged to the Guest for cleaning and deodorizing the Dwelling that is found to have smoke fumes upon vacating - above and beyond any damages.

Security & Safety Risks

Always lock doors and windows when you leave the vacation rental! When you rent the vacation rental, you assume responsibility for it and its contents, as well as your personal property. Always lock the doors and windows when you leave the Dwelling. Bluescape Vacation Rentals does not assume any responsibility for injuries resulting from your failure to use due caution. Children must always be supervised. Candles are not allowed due to fire hazard except citronella candles in buckets outside or supplied emergency candles in case of power outage.

Personal Property & Injury

(i) Owner Insurance: Guest personal property, including vehicles, are not insured by Owner or, if applicable, HOA, against loss or damage due to fire, theft, vandalism, rain, water, criminal or negligent acts of others, or any other cause. Owner/Management does not insure against personal injury to Guest, guests, or licensees due to any reason other than the condition of the Premises.

(ii) Guest Insurance: Management recommends that Guest carry or obtain insurance to protect Guest and licensees and their personal property from any loss or damage.

(iii) Indemnity and Hold Harmless: Guest agrees to indemnify, defend, and hold harmless Owner and Management from all claims, disputes, litigation, judgments, costs and attorney fees resulting from loss, damage or injury to Guest or licensees or their personal property.

Owner's Closets & Storage Areas

It is common for vacation homes to have locked owner's closets or storage spaces for the purpose of storing the Owner's personal items. These are not available for Guest use. Please respect these areas and do not attempt to open them. Any tampering will result in additional charges to the Guest.

Property

Guest rents, for vacation purposes only, the furnished real property and improvements described.

No Parties

All our rentals are in residential areas and may NOT be used for weddings, receptions, parties, or large gatherings. Any disruptive events could result in the eviction and forfeiture of the entire rental amount and security deposit.

Lost Items or Left Items at Rental

Management assumes no responsibility for lost, stolen, or abandoned items. Reasonable effort will be made to contact the Guest for return. There will be a $50 handling charge plus shipping costs for any found items returned at Guest’s request. Management shall not be held liable for the condition of said items. Any items not claimed for longer than 30 days may be donated or sold.

Illegal Substances

No illegal substances are allowed in the rental, and minors should not be in possession of alcohol. Violations will result in eviction from the property and no refunds will be issued.

Pools, Hot Tubs & Pool Heat/Chiller

Please shower prior to getting into the pool or hot tub. Wear swimwear in the pool or hot tub. Do not wear jewelry, shoes or non-swimwear in the pool or hot tub. If so equipped, spa heating is included. Pool heating or chilling is available by request on some pools; if available, unless solar equipped to heat or chill the pool, there is an additional fee of $14.29/day and must be paid for prior to use. If you wish for this to be turned on, please let your Rental Manager know at least 48 hours in advance. Guest agrees not to tamper with pool heat controls or manipulate heater in any way. Pool heat shall not exceed 86 degrees. Guest understands that the area surrounding pool and spa may not be fenced or secure. Guest understands and agrees to be responsible and liable for any damages that occur to the pool and spa and its support equipment through Guest misuse and/or negligence. The use of hot tubs is associated with certain health risks. Pregnant women, Guests with heart conditions, high blood pressure, diabetes and all children should not use hot tubs. We do not refund for malfunctioning hot tubs or pools. Upon departure, if any foreign items such as food, alcohol, cans, bath products, etc. are found in the pool or hot tub you will be charged the cleaning fee assessed from the pool company.

Unforeseen Circumstances

Management will not assume liability for any loss, damage or inconvenience caused by but not limited to the following: weather conditions, natural disasters, pests, construction, acts of God, or other reasons beyond its control. There shall be no refunds available as such instances are beyond the control of Management. It is highly recommended that Guest considers travel and/or rental insurance.

TV / Cable / Internet / Satellite

No refund shall be given for number of devices, outages, content, or lack of content or personal preferences with regard to cable/internet/satellite service. Services are provided as a convenience only and are not integral to this agreement. No refund shall be given for outages, content, lack of content, speed, access problems, lack of knowledge of use, or personal preferences with regard to service.

Weather / Mother Nature

We can not be held responsible for circumstances beyond our control. This includes excessive noise from construction or public/private events, wildfire/smoke, weather related interruptions, road closures, hurricanes, tropical weather and storms, interruption of services and utilities or unexpected appliance breakdown. 

Insects & Wildlife

Welcome to the Florida Keys where many insects and critters also reside. Especially during the warmer and summer months, the American Cockroach (commonly referred to as a "Palmetto Bug"), ants, mosquitoes, and sand fleas are unfortunate yet common invaders of residences. Bluescape Vacation Rentals does our best to keep these pests away and all of our properties are thoroughly cleaned and sanitized after every check-out and all of our rental properties receive routine pest control treatments. If you see the occasional roach, ant, or insect inside of the rental property this does not mean the rental property has not been cleaned thoroughly. Please understand that you are on an island and you may occasionally have "uninvited guests from nature." Bluescape Vacation Rentals does not relocate guests or issue refunds or discounts due to insect sightings. Some tips: Keep your unit as clean as possible. Keep food sealed and in the refrigerator. Bugs are attracted to food and water, so be sure to clean up where food is prepared and served, clean up spills and crumbs immediately and do not leave dirty dishes in sink or elsewhere. Bring bug repellant.

Air Conditioning / Heating

Guest agrees that Air conditioning shall not be set below 72 degrees and heat shall not be set above 78, and that the fan setting shall be “Auto”. Doors and windows shall be closed when either heat or air conditioning is in operation. There are no refunds for lack of, or malfunctioning HVAC units.

System(s) Failures

In the event the rental unit sustains a failure of a system, including but not limited to water, sewer, septic, electrical, gas, plumbing, mechanical, appliances, heat pump, ventilating, pool, hot tub or other system or structural systems, neither the property owner nor the Rental Manager shall be liable to Guest for damages, and no refunds will be given for such failures. However, Rental Manager will make every effort to promptly repair or replace the failed system or equipment, and in such event, Guest agrees to permit Manager or its service provider to have reasonable access to the property to inspect and make such repairs.

Termination of Occupancy

Upon termination of occupancy, Guest shall: (i) return all copies of all keys or opening devices to the Premises, including any common areas; (ii) vacate the Premises and surrender it to Management empty of all persons at agreed upon time; (iii) vacate any/all parking and/or storage space; and (iv) deliver the Premises to Management in the same condition less ordinary wear and tear as received upon arrival.

Rules & Regulations

NO COMMERCIAL USE. Guest agrees to comply with any and all rules and regulations that are at any time posted on the Premises or delivered to Guest. Guest shall not, and shall ensure that Guest and licensees of Guest shall not: (i) disturb, annoy, endanger, or interfere with other Guests of the building in which Premises is located or its neighbors; (ii) use the Premises for any commercial or unlawful purpose including, but not limited to, using, manufacturing, selling, storing, or transporting illicit drugs or other contraband; (iii) violate any law or ordinance; or (iv) commit waste or nuisance on or about the Premises.

Radon Gas Notice

Radon gas is a naturally occurring gas that can accumulate in a building and presents a health risk to those exposed to it over time. Levels of radon gas that exceed Federal and State guidelines have been found in buildings in Florida. Additional information may be obtained from the Monroe County Health Department FL Statute 404.0568

Substitutions

In the unlikely event that the home a Guest books is removed from Bluescape Vacation Rentals program or if extraordinary circumstances the home is deemed uninhabitable, Bluescape Vacation Rentals reserves the right to substitute a comparable property. If a comparable property is unavailable, then the Guest may choose from our available properties at the advertised rental rate or the Guest may request a refund.

Release, Indemnification and Hold Harmless

In consideration of the right to visit the home, Guest agrees to release to the fullest extent allowed by law, Owner and Bluescape Vacation Rentals, it's agents and vendors, members, officers, associates, representatives, attorneys, assigns, and affiliates (collectively, the Affiliates) from all liability or responsibility of any kind whatsoever for any personal injury, death, property damage or other loss sustained by me, my minor children, any guest identified on this form, or any guest or person allowed onto the property during my rental dates as a result of my, my children's or the guests participation in a visit to the home, due to any cause whatsoever, including without limitation negligence on the part of Owner or Bluescape Vacation Rentals. I understand that this release will bind my heirs, administrators, executors, and any other person or entity seeking to claim under or through me. While Bluescape Vacation Rentals and its property owners strive to maintain vacation properties in the finest condition, no guarantees are expressed nor implied regarding suitability or for any particular purpose. All Guest(s) and their invitees use the Dwelling at their own risk. Bluescape Vacation Rentals, the Rental Manager, their Agents and its Property Owners shall not be held liable or otherwise responsible in any way for injury to any Guest and/or their invitees that is caused or permitted to be caused by the intentional or unintentional acts of said Guest(s) and/or invitees, or by the failure of structures, appliances, (including hot tubs and BBQs) furnishings, and/or other equipment, whether by malfunction, misuse, acts of god/nature, and/or are otherwise naturally occurring. No guarantees are expressed nor implied as to the suitability of utilities and other services provided to the vacation properties and adjacent structures and premises. No guarantees are expressed nor implied regarding the suitability/compatibility of materials utilized in the construction of the vacation property and/or its contents. Bluescape Vacation Rentals and its Property Owners shall not be held liable nor otherwise responsible in any way for allergic reactions to Guest(s) or invitees, caused or permitted to be caused by materials utilized in the manufacture of the vacation property and/or its contents, nor from mold and/or airborne spores, nor from pet/animal allergens, nor from chemical agents including, but not limited to appliances, linens, carpeting, utensils, fixtures, hot tubs, and/or other equipment. By written or electronic endorsement of this agreement, guest(s) and invitees hereby agree to forever hold harmless and indemnify Bluescape Vacation Rentals and its Property Owners from and against all claims, demands, loss, liability/responsibility of any kind and character, including cost of defense, arising out of or in any way connected with the Guest(s) use of the Dwelling.

Waiver and Release of Liability

By this waiver, the undersigned and accompanying Guest(s) assume any risk and take full responsibility and waive any claims of personal injury, death or damage to personal property associated with the Dwelling subject to this agreement. This waiver includes but is not limited to man-made hazards associated with the property such as slippery shower basins, floors, staircases, balconies, porches, swimming pool and decks. This is to include such natural hazards such as falling or fallen coconuts, plants and bushes with sharp thorns, holes, ditches, culverts, falling or fallen trees and branches, fence pickets, uneven bricks or other irregularities of the property for any use including but not limited to: walking, jogging, dining, swimming, sun bathing or any other use on and off the premises, whether or NOT attributable to personal neglects or fault, including use of all bicycles, kayaks, canoes, paddleboards, scooters, electric cars and carts, or motorized vehicles whether deemed safe or otherwise. The undersigned further understand the Rental Manager of the Dwelling described herein, their agents, staff, employees, successors, and assigns make no claims or representations about the fitness for use of the property and make no warranties, either expressed or implied, as to the safety of the premises, and that the undersigned and guests are using said property at their own risk. Further, it is specifically stated that the property has not been child proofed and that children must be supervised at all times to prevent injury and harm. Furthermore, this WAIVER shall be deemed to include the waiver of any and all actions of third parties, including but not limited to, loud and boisterous neighbors, passer-buyers, and Owners. All Guests understand that their presence on this property may expose them to dangerous conditions including but not limited to hazards, whether man-made or natural, such as decking, balconies, pools, bricks and sharp rocks and animals, both natural and domestic including iguanas, snakes, insects, spiders, bees, wasps, frogs and toads, cat and dogs. On behalf of all Guests, the heirs, assigns and next of kin, the undersigned waives all claims for damages, injuries and death sustained to themselves, or their property that they may have against the aforementioned released party due to such conditions. The undersigned Guest(s) hereby indemnify, hold harmless and forever discharge the Rental Manager and Agent of the Premises – the address of said Premises listed on this Agreement from any and all claims, demands, debts, contacts and expenses, causes of action, lawsuits – of every kind and nature, including claims of negligence, whether known or unknown, in law and equity, arising from or in any way related to the Guest staying on the Premises.

Mediation

Guest agrees to mediate any dispute or claim arising out of this Agreement, or any resulting transaction, before resorting to arbitration or court action. Mediation fees, if any, shall be divided equally among the parties involved.

Entire Contract

Time is of the essence. All prior agreements between Owner and Guest are incorporated in this Agreement, which constitutes the entire contract. It is intended as a final expression of the parties agreement and may not be contradicted by evidence of any prior agreement or contemporaneous oral agreement. The parties further intend that this Agreement constitutes the complete and exclusive statement of its terms, and that no extrinsic evidence whatsoever may be introduced in any judicial or other proceeding, if any, involving this Agreement. Any provision of this Agreement that is held to be invalid shall not affect the validity or enforceability of any other provision in this Agreement. The waiver of any breach shall not be construed as a continuing waiver of the same or any subsequent breach.

Errors & Omissions

Every effort has been made to provide accurate and complete information in both printed materials and on our website; however, Bluescape Vacation Rentals is not responsible for printing or posting errors, omissions, equipment failure, changes in rates, amenities or furnishings made by homeowners, or changes in views, neighborhoods or amenity access and availability.

ID or valid Passport is the only forms of identification accepted. Noncompliance will result in

forfeiture of all monies paid and Rental Manager’s right of refusal to allow access to the Rental.

Guest shall not sublet Rental or allow anyone to share Rental without Rental Manager's prior

written consent.

Arrival & Departure

Check-in time is no earlier than 4:00 PM on arrival date. This time may be delayed should

unforeseen circumstances arise. Check-out time is NO LATER than 10:00 AM on the departure

date. If available, an early Check In and/or late Check Out option may be available for an

additional fee (Not an option during Peak Times). If Early Check and/or Late check out are

approved you will get a email confirmation from the reservation team.

Reservations

All Reservations are subject to Bluescape Vacation Rentals and Property Owner approval.

Online rates are subject to change without notice. Should there be ANY issues with the

reservation, you will be contacted within 48 hours.

Payments and Credit Card Authorization and Auto-charging

Initial deposit payment of 25% due at time of booking, plus either $55 Damage Waiver Policy or

a Security Deposit (minimum of $1000 and varies based on location of rental property). Outside

of 60 days of arrival, Initial deposit payment is due to reserve property. if Deposit. If Guest

reserved with a credit card at time of booking, that credit card will be charged automatically the

full remaining balance due. Within 60 Days of Arrival, Total Cost is due to reserve property. We

offer Vacation Rental Insurance at 7.65% of the total rental rate.

Security Deposit / Damage Waiver Policy

Bluescape Vacation Rentals HIGHLY recommends Guest to purchase the Damage Waiver

Policy for $55. This Damage Waiver policy may cover the insured Guest's unintentional

damages to the interior of the Rental

or damages to real or personal property of the Rental as a result of inadvertent acts or

omissions during your stay provided these damages are disclosed to the Rental Manager in

writing prior to check-out. The Insurer will reimburse the cost(s) of repair or replacement of such

property up to a maximum benefit of $3000. Certain terms and conditions apply. If you do not

wish to purchase the Damage Waiver policy, a minimum of $1000 Security Deposit will be

required (this Security Deposit amount will vary based on the individual Rental property's

requirements.)

If Guest purchases the Damage Waiver Policy, the Security Deposit will not be necessary. If

Guest does not purchase the Damage Waiver Policy, the security deposit will be required at

time of booking. The security deposit is fully refundable within 15 days of check-out providing

there is no damage, excess utilities as noted in the property description, excess cleaning or

inventory unaccounted for including, but not limited to keys and/or gate passes.

Damages caused by Guest

A Valid Credit Card to be kept on file is required upon Reservation. Your reservation will either

charge $55.00 for a Damage waiver to cover up to $3,000.00 in damage or we will collect a

security deposit at time of booking. Should any Guest damages cost above the coverage of the

damage waiver or above the amount of security deposit, the Credit Card on file will be charged

for any of these costs. Guest hereby grants consent to charge Credit Card on file for any

damages, missing items, excessive cleaning, fines, and, if necessary, cost incurred to remove

Guest from property.

Utilities & Excessive Charges

Utilities are provided at each rental property. Any excessive uses will be charged to the Guest.

Violations of any local water restrictions / ordinances will be charged to the Guest. Please

ensure that all faucets and TVs are turned off at the time of departure. Please leave the air

conditioner on and ensure the thermostat is set to a temperature between 72-78 degrees with

fan speed set to Auto. Keep windows and doors closed while the air conditioner or heater are

turned on. Do not leave your windows or doors open as this will cause the air conditioning unit

to freeze up and/or malfunction and may result in additional repair charges to Guest.

Occupancy

Approved Guests are persons who will occupy the Premises. No unlawful activity or any other

activity that constitutes a nuisance is permitted on the Premises. Approved Guests take full

responsibility for all lost or broken items, and any damages to the Property of any kind. The

number of Guests as it appears on your reservation confirmation, is the maximum total

occupancy. Unauthorized people at the vacation rental at any time is considered a violation of

the rental agreement and will cause immediate eviction. No exceptions or refunds are given for

changes in the number of Guests after your arrival. Please inform us of any change in the

number of Guests before your arrival to avoid any problems with your stay. We will be happy to

attempt to accommodate you with an additional Rental, if available and needed.

Housekeeping and Condition of Premises

Our goal is to provide you with the cleanest accommodation possible. Guest shall, on arrival,

examine the Premises, all furniture, furnishings, appliances, fixtures, and landscaping, if any,

and shall immediately report, in writing, if any are not in operating condition or are in disrepair.

Reporting repairs does not give Guest the right to cancel this Agreement or receive a refund of

any payments made. Please call the Rental Manager if the home is not cleaned to your

satisfaction upon check-in. Our housekeeping team will correct the problem in a timely and

professional manner. We cannot be held accountable for problems we are not aware of, please

let us know at time of check-in.

You are charged a cleaning fee when you make your reservation. Housekeepers do not wash

dishes or pick up trash around the vacation rental. Do not place any bait, unwrapped fish or

lobster in the refrigerator or freezer unless it is specifically labeled as Bait Storage. Bait and

unwrapped fish or lobster must be kept in an outside cooler or labeled bait freezer only. The

cleaning fee allows up to two loads of laundry. The Guest will be charged additional cleaning

fee(s) for any excessive cleaning or excessive laundry.

Please return the vacation rental neat and orderly at check-out.

If you are staying a week or longer and want additional cleanings, we'll be happy to arrange that

for an additional fee.

Trash

Garbage pick-up days are Monday and Thursday mornings. Trash must be put inside a plastic

garbage can before placing it in trash receptacles. Please place trash cans by the curb for pick

up the night before. Recycling pick-up is on Wednesday.

Maintenance & Reporting

Guest shall properly use, operate, and safeguard the Premises including, if applicable, any

landscaping, furniture, furnishings, appliances and all mechanical, electrical, gas and plumbing

fixtures, and keep them clean and sanitary. Guest shall immediately notify Rental Manager of

any problem, malfunction, or damage. Guest shall pay for all repairs or replacements caused

by Guest, excluding ordinary wear and tear. Guest shall pay for all damage to the Premises as

a result of failure to report a problem, malfunction or damage in a timely manner.

Strict Noise Ordinance

Monroe County has a strict noise ordinance that must be followed. Guest will maintain that

noise levels on the property and inside the dwelling do not impede the quiet enjoyment of others

in the neighborhood. A violation of any law or covenant that results in a disturbance will be just

cause for immediate eviction and forfeiture of all rent paid and forfeiture of the entire security

deposit. No loud noises, music, loud vehicles are allowed between the hours of 10:00 pm and

7:00 am. Please note that if these rules are not followed you can be fined and asked to vacate

the property.

Terms include a No Tolerance Policy regarding excessive noise, parties, or disturbing

neighbors. Please make sure you are comfortable with our Terms as they are strictly enforced.

Cancellations & Trip Insurance

Reservations for this property are fully refundable with atleast 60 days written notice prior to

 

check-in. 60 days from check-in full payment will be due by Guest. Reservations are non-

refundable within 60 days of check-in. However, the Rental Manager will attempt to rebook the

 

rental property to another Guest. If Rental Manager is able to rebook the full stay, Guest will be

refunded their entire rental rate amount minus a $250 cancellation fee. If Guest must cancel

reservation less than 60 days from check-in, but we do offer trip insurance/cancelation policy

that costs 7.65% of the gross rental fee and allows you to cancel with certain conditions and

restrictions. Please speak with your Rental Manage for more details. This can only be

purchased at the time of the reservation.

Returned Checks

Guests will be responsible for a $50 returned check fee in addition to a fee of $100 or 10% of

the face value of the check, whichever amount is greater. This is for any check returned for

insufficient or uncollected funds.

Keys

In the event that the Rental Manager decides, in its unfettered discretion, that the loss of the

keys by the guest represents a significant security risk to the property, a $400 re-keying fee will

be assessed and charged to the Guest.

Emergencies / Maintenance / Service Calls

In the event of a problem getting in the vacation rental or if there are problems with the condition

or functionality of the vacation rental, please immediately contact your Rental Manager and the

Bluescape Vacation Rentals office at 305-395-3799. If it is after office hours, we will make every

effort to return your call as soon as possible. Maintenance - Regular maintenance is performed

on all properties, and every effort is made to keep all equipment in working order. However, as

with all homes, malfunctions do occur unexpectedly. If something is not working, please notify

the office immediately. Please respect that emergencies take precedence. Any problems must

be addressed immediately. Bluescape Vacation Rentals cannot be held accountable for

problems that we are not aware of, so please notify us as issues occur. Housekeeping or

maintenance problems will not be addressed at check-out or after departure. However, under no

circumstances will there be any discounts or reduction in rents or refunds for any mechanical

failure of air conditioners, dishwashers, refrigerators, washers, dryers, TV, internet service,

swimming pools, spas, appliances or amenities. Service calls - Tenants will pay for any

unwarranted service calls, such as plumbing, electric, air- conditioning, etc. If the repair

technician determines that the call was unwarranted or caused by renter error, the service call

and repair will be deducted from the security deposit. Nothing but septic safe toilet paper

products in the toilet. Plungers are provided if a clog occurs. Please do not pour grease down

the drains.

Right of entry

Guest(s) agree that Bluescape Vacation Rentals reserves the right to enter the rental property

at any time to investigate disturbances, check occupancy, check for damage, to make repairs,

alterations, or improvements as we may deem appropriate.

Smoking

NO SMOKING IS PERMITTED INSIDE THE DWELLING. Smoking is only allowed outside at

some of our rental properties. Oil lamps and incense are not permitted due to the long-lasting

odor. If these policies are violated, there is a $1000 fee that will be charged to the Guest for

cleaning and deodorizing the Dwelling that is found to have smoke fumes upon vacating - above

and beyond any damages.

Security & Safety Risks

Always lock doors and windows when you leave the vacation rental! When you rent the vacation

rental, you assume responsibility for it and its contents, as well as your personal property.

Always lock the doors and windows when you leave the Dwelling. Bluescape Vacation Rentals

does not assume any responsibility for injuries resulting from your failure to use due caution.

Children must always be supervised. Candles are not allowed due to fire hazard except

citronella candles in buckets outside or supplied emergency candles in case of power outage.

Personal Property & Injury

(i) Owner Insurance: Guest personal property, including vehicles, are not insured by Owner or, if

applicable, HOA, against loss or damage due to fire, theft, vandalism, rain, water, criminal or

negligent acts of others, or any other cause. Owner/Management does not insure against

personal injury to Guest, guests, or licensees due to any reason other than the condition of the

Premises. (ii) Guest Insurance: Management recommends that Guest carry or obtain insurance

to protect Guest and licensees and their personal property from any loss or damage. (iii)

Indemnity and Hold Harmless: Guest agrees to indemnify, defend, and hold harmless Owner

and Management from all claims, disputes, litigation, judgments, costs and attorney fees

resulting from loss, damage or injury to Guest or licensees or their personal property.

Owner's Closets & Storage Areas

It is common for vacation homes to have locked owner's closets or storage spaces for the

purpose of storing the Owner's personal items. These are not available for Guest use. Please

respect these areas and do not attempt to open them. Any tampering will result in additional

charges to the Guest.

Property

Guest rents, for vacation purposes only, the furnished real property and improvements

described.

 

No Parties

All our rentals are in residential areas and may NOT be used for weddings, receptions, parties,

or large gatherings. Any disruptive events could result in the eviction and forfeiture of the entire

rental amount and security deposit.

Lost Items or Left Items at Rental

Management assumes no responsibility for lost, stolen, or abandoned items. Reasonable effort

will be made to contact the Guest for return. There will be a $50 handling charge plus shipping

costs for any found items returned at Guest’s request. Management shall not be held liable for

the condition of said items. Any items not claimed for longer than 30 days may be donated or

sold.

Illegal Substances

No illegal substances are allowed in the rental, and minors should not be in possession of

alcohol. Violations will result in eviction from the property and no refunds will be issued.

Pools, Hot Tubs & Pool Heat/Chiller

Please shower prior to getting into the pool or hot tub. Wear swimwear in the pool or hot tub. Do

not wear jewelry, shoes or non-swimwear in the pool or hot tub. If so equipped, spa heating is

included. Pool heating or chilling is available by request on some pools; if available, unless solar

equipped to heat or chill the pool, there is an additional fee of $14.29/day and must be paid for

prior to use. If you wish for this to be turned on, please let your Rental Manager know at least

48 hours in advance. Guest agrees not to tamper with pool heat controls or manipulate heater

in any way. Pool heat shall not exceed 86 degrees. Guest understands that the area

surrounding pool and spa may not be fenced or secure. Guest understands and agrees to be

responsible and liable for any damages that occur to the pool and spa and its support

equipment through Guest misuse and/or negligence.

The use of hot tubs is associated with certain health risks. Pregnant women, Guests with heart

conditions, high blood pressure, diabetes and all children should not use hot tubs. We do not

refund for malfunctioning hot tubs or pools.

Upon departure, if any foreign items such as food, alcohol, cans, bath products, etc. are found

in the pool or hot tub you will be charged the cleaning fee assessed from the pool company.

Unforeseen Circumstances

Management will not assume liability for any loss, damage or inconvenience caused by but not

limited to the following: weather conditions, natural disasters, pests, construction, acts of God,

or other reasons beyond its control. There shall be no refunds available as such instances are

beyond the control of Management. It is highly recommended that Guest considers travel and/or

rental insurance.

TV / Cable / Internet / Satellite

No refund shall be given for number of devices, outages, content, or lack of content or personal

preferences with regard to cable/internet/satellite service. Services are provided as a

convenience only and are not integral to this agreement. No refund shall be given for outages,

content, lack of content, speed, access problems, lack of knowledge of use, or personal

preferences with regard to service.

Weather / Mother Nature

We cannot be held responsible for circumstances beyond our control. This includes excessive

noise from construction or public/private events, wildfire/smoke, weather related interruptions,

road closures, hurricanes, tropical weather and storms, interruption of services and utilities or

unexpected appliance breakdown.

Insects & Wildlife

Welcome to the Florida Keys where many insects and critters also reside. Especially during the

warmer and summer months, the American Cockroach (commonly referred to as a "Palmetto

Bug"), ants, mosquitoes, and sand fleas are unfortunate yet common invaders of residences.

Bluescape Vacation Rentals does our best to keep these pests away and all of our properties

are thoroughly cleaned and sanitized after every check-out and all of our rental properties

receive routine pest control treatments. If you see the occasional roach, ant, or insect inside of

the rental property this does not mean the rental property has not been cleaned thoroughly.

Please understand that you are on an island and you may occasionally have "uninvited guests

from nature." Bluescape Vacation Rentals does not relocate guests or issue refunds or

discounts due to insect sightings. Some tips: Keep your unit as clean as possible. Keep food

sealed and in the refrigerator. Bugs are attracted to food and water, so be sure to clean up

where food is prepared and served, clean up spills and

crumbs immediately and do not leave dirty dishes in sink or elsewhere. Bring bug repellant.

Air Conditioning / Heating

Guest agrees that Air conditioning shall not be set below 72 degrees and heat shall not be set

above 78, and that the fan setting shall be “Auto”. Doors and windows shall be closed when

either heat or air conditioning is in operation. There are no refunds for lack of, or malfunctioning

HVAC units.

System(s) Failures

In the event the rental unit sustains a failure of a system, including but not limited to water,

sewer, septic, electrical, gas, plumbing, mechanical, appliances, heat pump, ventilating, pool,

hot tub or other system or structural systems, neither the property owner nor the Rental

Manager shall be liable to Guest for damages, and no refunds will be given for such failures.

However, Rental Manager will make every effort to promptly repair or replace the failed system

or equipment, and in such event, Guest agrees to permit Manager or its service provider to

have reasonable access to the property to inspect and make such repairs.

Termination of Occupancy

Upon termination of occupancy, Guest shall: (i) return all copies of all keys or opening devices

to the Premises, including any common areas; (ii) vacate the Premises and surrender it to

Management empty of all persons at agreed upon time; (iii) vacate any/all parking and/or

storage space; and (iv) deliver the Premises to Management in the same condition less ordinary

wear and tear as received upon arrival.

Rules & Regulations

NO COMMERCIAL USE. Guest agrees to comply with any and all rules and regulations that are

at any time posted on the Premises or delivered to Guest. Guest shall not, and shall ensure that

Guest and licensees of Guest shall not: (i) disturb, annoy, endanger, or interfere with other

Guests of the building in which Premises is located or its neighbors; (ii) use the Premises for

any commercial or unlawful purpose including, but not limited to, using, manufacturing, selling,

storing, or transporting illicit drugs or other contraband; (iii) violate any law or ordinance; or (iv)

commit waste or nuisance on or about the Premises.

Radon Gas Notice

Radon gas is a naturally occurring gas that can accumulate in a building and presents a health

risk to those exposed to it over time. Levels of radon gas that exceed Federal and State

guidelines have been found in buildings in Florida. Additional information may be obtained from

the Monroe County Health Department FL Statute 404.0568

Substitutions

In the unlikely event that the home a Guest books is removed from Bluescape Vacation Rentals

program or if extraordinary circumstances the home is deemed uninhabitable, Bluescape

Vacation Rentals reserves the right to substitute a comparable property. If a comparable

property is unavailable, then the Guest may choose from our available properties at the

advertised rental rate or the Guest may request a refund.

Release, Indemnification and Hold Harmless

In consideration of the right to visit the home, Guest agrees to release to the fullest extent

allowed by law, Owner and Bluescape Vacation Rentals, it's agents and vendors, members,

officers, associates, representatives, attorneys, assigns, and affiliates (collectively, the Affiliates)

from all liability or responsibility of any kind whatsoever for any personal injury, death, property

damage or other loss sustained by me, my minor children, any guest identified on this form, or

any guest or person allowed onto the property during my rental dates as a result of my, my

children's or the guests participation in a visit to the home, due to any cause whatsoever,

including without limitation negligence on the part of Owner or Bluescape Vacation Rentals. I

understand that this release will bind my heirs, administrators, executors, and any other person

or entity seeking to claim under or through me.

While Bluescape Vacation Rentals and its property owners strive to maintain vacation properties

in the finest condition, no guarantees are expressed nor implied regarding suitability or for any

particular purpose. All Guest(s) and their invitees use the Dwelling at their own risk. Bluescape

Vacation Rentals, the Rental Manager, their Agents and its Property Owners shall not be held

liable or otherwise responsible in any way for injury to any Guest and/or their invitees that is

caused or permitted to be caused by the intentional or unintentional acts of said Guest(s) and/or

invitees, or by the failure of structures, appliances, (including hot tubs and BBQs) furnishings,

and/or other equipment, whether by malfunction, misuse, acts of god/nature, and/or are

otherwise naturally occurring. No guarantees are expressed nor implied as to the suitability of

utilities and other services provided to the vacation properties and adjacent structures and

premises. No guarantees are expressed nor implied regarding the suitability/compatibility of

materials utilized in the construction of the vacation property and/or its contents. Bluescape

Vacation Rentals and its Property Owners shall not be held liable nor otherwise responsible in

any way for allergic reactions to Guest(s) or invitees, caused or permitted to be caused by

materials utilized in the manufacture of the vacation property and/or its contents, nor from mold

and/or airborne spores, nor from pet/animal allergens, nor from chemical agents including, but

not limited to appliances, linens, carpeting, utensils, fixtures, hot tubs, and/or other equipment.

By written or electronic endorsement of this agreement, guest(s) and invitees hereby agree to

forever hold harmless and indemnify Bluescape Vacation Rentals and its Property Owners from

and against all claims, demands, loss, liability/responsibility of any kind and character, including

cost of defense, arising out of or in any way connected with the Guest(s) use of the Dwelling.

Waiver and Release of Liability

By this waiver, the undersigned and accompanying Guest(s) assume any risk and take full

responsibility and waive any claims of personal injury, death or damage to personal property

associated with the Dwelling subject to this agreement. This waiver includes but is not limited to

man-made hazards associated with the property such as slippery shower basins, floors,

staircases, balconies, porches, swimming pool and decks. This is to include such natural

hazards such as falling or fallen coconuts, plants and bushes with sharp thorns, holes, ditches,

culverts, falling or fallen trees and branches, fence pickets, uneven bricks or other irregularities

of the property for any use including but not limited to: walking, jogging, dining, swimming, sun

bathing or any other use on and off the premises, whether or NOT attributable to personal

neglects or fault, including use of all bicycles, kayaks, canoes, paddleboards, scooters, electric

cars and carts, or motorized vehicles whether deemed safe or otherwise. The undersigned

further understand the Rental Manager of the Dwelling described herein, their agents, staff,

employees, successors, and assigns make no claims or representations about the fitness for

use of the property and make no warranties, either expressed or implied, as to the safety of the

premises, and that the undersigned and guests are using said property at their own risk.

Further, it is specifically stated that the property has not been child proofed and that children

must be supervised at all times to prevent injury and harm. Furthermore, this WAIVER shall be

deemed to include the waiver of any and all actions of third parties, including but not limited to,

loud and boisterous neighbors, passer-buyers, and Owners. All Guests understand that their

presence on this property may expose them to dangerous conditions including but not limited to

hazards, whether man-made or natural, such as decking, balconies, pools, bricks and sharp

rocks and animals, both natural and domestic including iguanas, snakes, insects, spiders, bees,

wasps, frogs and toads, cat and dogs. On behalf of all Guests, the heirs, assigns and next of

kin, the undersigned waives all claims for damages, injuries and death sustained to themselves,

or their property that they may have against the aforementioned released party due to such

conditions. The undersigned Guest(s) hereby indemnify, hold harmless and forever discharge

the Rental Manager and Agent of the Premises – the address of said Premises listed on this

Agreement from any and all claims, demands, debts, contacts and expenses, causes of action,

lawsuits – of every kind and nature, including claims of negligence, whether known or unknown,

in law and equity, arising from or in any way related to the Guest staying on the Premises.

Mediation

Guest agrees to mediate any dispute or claim arising out of this Agreement, or any resulting

transaction, before resorting to arbitration or court action. Mediation fees, if any, shall be divided

equally among the parties involved.

Entire Contract

Time is of the essence. All prior agreements between Owner and Guest are incorporated in this

Agreement, which constitutes the entire contract. It is intended as a final expression of the

parties` agreement and may not be contradicted by evidence of any prior agreement or

contemporaneous oral agreement. The parties further intend that this Agreement constitutes the

complete and exclusive statement of its terms, and that no extrinsic evidence whatsoever may

be introduced in any judicial or other proceeding, if any, involving this Agreement.

Any provision of this Agreement that is held to be invalid shall not affect the validity or

enforceability of any other provision in this Agreement. The waiver of any breach shall not be

construed as a continuing waiver of the same or any subsequent breach.

Errors & Omissions

Every effort has been made to provide accurate and complete information in both printed

printing or posting errors, omissions, equipment failure, changes in rates, amenities or

furnishings made by homeowners, or changes in views, neighborhoods or amenity access and

availability.
